The Montana Department of Revenue (DOR) operates in a way that’s similar to the IRS in terms of income tax regulation. One of the DOR’s primary functions is to ensure that all tax revenue is properly collected. Residents who owe unfiled or unpaid taxes may find themselves facing penalties and accruing interest if they address their tax debt. If you owe back taxes in Montana, the Department of Revenue offers several options to help you resolve the situation.
Montana Payment Plan
If you can’t afford to pay the full amount of back taxes owed, you may be able to qualify for a payment plan. As a general rule, the Department of Revenue does not accept payment plans for less than $50 a month and plans can last no more than twelve months. Short-term plans are available when no other payment options are available.
If you’re not able to pay more than $50 a month or you need more than 12 months to pay, the DOR will still consider your application. However, you’ll need to provide a complete financial statement before the plan is approved. You may also be subject to a lien against your property until the tax debt is paid.
To apply for a payment plan, you apply online by leveraging their TransAction Portal (TAP).
If your payment plan is approved, you’ll need to set up an automatic bank deduction from your checking or savings account. Payments can be made weekly, biweekly or monthly, depending on your preference.
Offer in Compromise
When you owe back taxes, penalties and interest continue to accrue, which can make it seemingly impossible to pay the balance down. In cases where a taxpayer is unlikely to repay the debt in full, the Department of Revenue used to consider an Offer In Compromise but not anymore.
Voluntary Disclosure Program
If you think you owe back taxes, the Montana Department of Revenue encourages you to take advantage of the Voluntary Disclosure Program. The program is designed to help taxpayers avoid additional penalties and fees by voluntarily registering to pay their back tax obligation. In order to participate in the program, you must not have had any previous contact with the DOR regarding your tax liability, including receipt of an audit notification. You must agree to pay all of the unpaid tax plus any interest that has accrued as a result.
