Similar to the Internal Revenue Service, the Mississippi Department of Revenue is responsible for regulating the collection of income taxes at the state level, including back taxes. If you’re a Mississippi resident who owes unfiled or unpaid taxes, the Department of Revenue wants to assist you in meeting your tax obligation. There are several remedies available to help you deal with your back taxes owed.
Mississippi Installment Agreement
Taxpayers who find themselves financially unable to pay their outstanding tax bill in full may have the option of completing an installment agreement. The Mississippi Department of Revenue allows residents to apply for an installment agreement if their tax liability ranges from $75 to $3,000. In order to apply for an installment agreement, you must complete Form 71-661 and return it to:
Income Tax Bureau
Post Office Box 22805
Jackson, MS 39225-2805
Approval for an installment agreement is based on several factors. Generally, to qualify for a payment plan you (and your spouse if you filed a joint return) must have filed all your tax returns for the previous five years and you must have paid all taxes due during that time. You can’t qualify for an installment agreement if you completed one in the previous five years.
If your application for an installment agreement is approved, you must agree to pay the full amount of unpaid tax within twelve months. During the repayment period, interest will continue to accrue at a rate of 1% per month. If you file bankruptcy at any point during the repayment period, you must contact the Department of Revenue at (601) 923-7393 to notify them of your filing.
You can make payments and monitor your repayment progress online through the Mississippi Taxpayer Access Point (TAP).
Penalty Abatement
If the Department of Revenue determines that you have an outstanding tax liability, they will provide you with a detailed statement of any penalties that have been levied against you. If you disagree with the penalties, you can ask for a penalty abatement to have them waived. In order to request penalty abatement, you must contact the Mississippi DOR at (601) 923-7000.
If You Don’t Pay
If you’re not proactive about dealing with an overdue tax bill, the Mississippi Department of Revenue can take certain actions against you. The DOR can enforce a wage garnishment order until the liability is satisfied and they can also levy your bank account. In addition, any future tax refunds you receive can be seized and applied to your outstanding tax liability. Contacting the Department of Revenue promptly to discuss your tax situation can help you to avoid these actions.
