While the IRS regulates taxes on a national level, each state also has its own individual tax agency. In Idaho, the State Tax Commission is responsible for issuing tax refunds, processing returns and ensuring that all taxes due are collected.
If you’ve received a notice from the Idaho State Tax Commission that you owe back taxes, you need to know what your options are. There are several programs available to help Idaho residents pay their past due tax bills.
If you can’t pay your tax bill in full, you may be able to qualify for a payment agreement. A payment agreement lets you pay down the taxes owed over time. To be eligible, you must be up to date on filing all other tax returns and agree to avoid any future taxes owed.
To apply for a payment agreement, you’ll need to complete Form 40PA and attach a voided check or deposit slip to set up automatic payments from your bank account. You may also need to complete Form CFS, which is a comprehensive financial statement detailing your assets, income and expenses. These forms can be mailed to:

Once your application is received, the State Tax Commission will review your paperwork and make a final determination. If your application is approved, you’ll be subject to a state tax lien on any property you own until the liability is paid in full.
The IRS offers programs to help taxpayers settle their back taxes owed and Idaho taxpayers may also have the same option in the form of an Offer in Compromise (OIC). An Offer in Compromise is typically a preferable alternative if you can’t make regular payments or the penalties and interest you owe are making it impossible to pay the balance down.
When you make an Offer in Compromise, you’re agreeing to pay a certain amount of the taxes owed. The rest of your taxes owed is eliminated. Not everyone will qualify for an Offer in Compromise and the State Tax Commission urges taxpayers to call (800) 972-7660 for more details on who qualifies and how to apply.
While the State Tax Commission can’t eliminate the interest on a back taxes owed, they may be willing to waive penalties in certain situations. If you’ve been assessed a penalty for unpaid taxes, you can contact the Tax Commission to ask for a penalty waiver.
