Before appearing on Survivor, Hatch lived a modest lifestyle, holding jobs from car sales to bartending to pay off the bills. Hatch even served in the military for five years, but apparently his proclaimed self discipline and restraint skills only served him well for so long. Reportedly, The IRS filed a $1,742,711 tax lien against Hatch earlier this year, with tax debts reaching as far back as 2000; the very year he won the title of Survivor.

And this isn’t the first time. In January of 2005, the US Attorney’s Office filed a claim against the Survivor for failing to report his winnings received on the final show- perhaps he thought they missed that episode? As if this wasn’t bad enough, Hatch continued to inaccurately record even more post show earnings, such as the $321,000 he received from his appearance on the WQSX-FM radio show in Boston later that year.

Initial charges against Hatch were lenient, with agreements arranged after a guilty plea on his behalf.  However, Hatch shortly thereafter pulled out of the arrangement, only to stir up more trouble.

For some reason, I don’t think that the IRS will be so prone to allowing Hatch to run away with the money as his fellow contestants were, but I guess we’ll just have to wait and see.

Don’t Wait

While you may feel there is no point in sending in late documents, you absolutely need to act now. File your return as soon as it is complete. A tax professional can help you complete your filing but will be an added expense. Sign all your forms and send them via US Mail with Certified/Return Receipt services to ensure the tax office has received your paperwork.

If You Don’t Owe Taxes

When you complete your taxes and find the IRS owes you money, you will not be penalized. The only downside for you is your refund will be delayed. You can actually get refunds for taxes filed up to three years passed due but finally so late is not something you should attempt.

If You Do Owe Taxes

Send in a check for as much as you can afford. Your penalties for a late filing will depend on how much you owe in back taxes. The late filing penalty is currently at 5% of the total amount you owe to the government for each month you are late. Even if you are only one day late, the penalty for the full month is incurred. There will also be accrued interest at a rate that depends on the current market.

If you need to make payment arrangements, you will also need to include a completed Installment Agreement form with your filings. The Installment Agreement is your request to make monthly payment arrangements to pay off your total debt. It will depend on the total amount you owe and how much money you can afford to pay in each month until the debt is satisfied.

Facing the Fees

Penalties can get quit costly and the later you file, the stiffer the penalty. Even one day late will accrue penalties and interest which increases the overall amount you owe back. The penalty for filing just one day late is 5% of the original balance owed. The maximum penalty for failing to file by April 15 is 25% which is reached by September 16^th, five months after the original due date. Taxes not filed within 60 days of the due date will be penalized whichever is the lesser of $135 or 100% of the unpaid tax amount.

Fraudulent Issues

If you have not filed your taxes with the intention to commit fraud, expect a significantly higher tax penalty. The rate for penalty will be increased from 5% a month to 15% a month. The maximum amount of penalty can be 75% of the original total amount of taxes owned. This penalty is not initiated very often but the IRS will enforce this penalty if fraud is obviously being attempted.

Dealing With Penalties

The IRS has the direct authority to reduce your tax penalties or even eliminate them altogether provided you make the proper request (penalty abatement). If you can prove ‘reasonable cause’ for not filing your taxes on time, you may have your penalties reduced or waived. The type of permissible excuses varies on a case-by-case basis.

Overall, the IRS wants to work with people who want to be helped. Communication is essential in working through the process of filing late taxes. If you are upfront with the IRS and make an honest attempt to make good on your debts, you can work through the process relatively unscathed. On the other hand, if you choose to ignore your tax obligations or try to cheat the IRS on taxes, you’ll pay considerably not only in taxes but you can face possible legal consequences.

In an interesting statistic, it is noted that about half of taxpayers paid no federal income tax last year. While that sounds like a very high percentage of people not required to pay Uncle Sam, the statistic does not mean that these same people paid no taxes at all. Many still had to pay out for Social Security and Medicare payroll taxes. Property taxes were also paid plus a variety of sales tax had to be paid out as well.

Who’s Not Paying?

Those quick to criticize this statistical statement also claim that only the hard working Americans are paying taxes and those who are on welfare or even the mega-wealthy folks don’t pay out a dime. This is serious misconception. In reality, those people who pay no federal income tax are typically the elderly and those who do not make much money at all. Those families earning incomes of less that $20,000 will likely not pay out in federal taxes.

As we are still struggling to beat back the recession, it should be noted that there was a tremendous amount of job loss during the last few years. Along with no income or less income after taking a new job, the amount of income tax due also goes down. As time goes by, the number of Americans not paying federal income taxes will also decrease. As jobs become more plentiful and wages increase, so will tax responsibilities.

Tax Relief Measures

One of the biggest reason people have not had to pay out much, if at all, in federal income taxes is due to the Earned Income Tax Credit. This credit was brought about in 1975 and over the years has been expanded under different Presidents. People who are working at low wages can use the credit from low wages to cancel out their liability for income taxes. The Earned Income Tax Credit and the child care credit were established to encourage people to keep working.

Not a New Concept

Historically, not owing federal income taxes is not a new concept. Before World War II, rarely did an American pay income tax. In the 1950’s, most only paid a very small percentage in Social Security tax. Medicare taxes were not yet established then. Today, workers are actually paying more in payroll taxes than they are in federal income taxes.

While the 50% statistic can be startling to people at first glance, the percentage certainly dwindles down to near nothing when you consider all of the other taxes being paid out by both working and non-working individuals. It is easy for some to feed off the notion they are being cheated in the tax arena but for decades, the government has been making decisions based on removing low-income working families from the income tax lists. Right now the policy is working as it was meant to work. As income levels pick back up, the percentage of those not paying federal taxes will begin to decline rather quickly.

A garnishment means that the tax office can legally take the majority of your paycheck before you get any of the money. For those living paycheck to paycheck, a garnishment is a serious matter. The percentage taken in a garnishment from the IRS is generally a large one and will be based on your marital filing status as well as the number of dependents you claim. The amount of your pay that is exempt from the garnishment is figured out by adding the standard deduction claimed on your taxes and the amount you claim as exemptions. That number is then divided by 52. A typical example would be the calculation of a family of three. After their calculations were done, they would only be able to keep around $325 per week per pay. State tax garnishments have individual standards for the amount of percentage they can take towards the debt.

Since the loss of pay will be a bigger burden on an already stressed financial situation, it is important that anyone owning federal or state tax money do whatever they can to take care of the debt before a garnishment is ordered. Installments plans or even legal assistance from a tax attorney can help avoid a garnishment situation before it occurs. Once a garnishment is started, it will stay in effect until fully paid. Otherwise, additional costs of legal assistance will only add additional financial burdens.

Tax attorneys can help to deal with the IRS or the state in order to negotiate a release of the garnishment. Alternative payment amounts may also be negotiated to make the garnishment less severe but again the attorney costs add to the debt already outstanding. However, if you contact the IRS or state tax office as soon as you know you’ll have difficulty making payments, you can avoid the garnishment and the difficulties that come with losing most of your paycheck each week until the debt has been satisfied.

Look For and Gather Tax Paperwork

Get a copy of the tax return for the last year that you filed. For all years you haven’t filed yet, look for w-2s from employers and any other forms you may have been mailed for investments, savings accounts, insurance, etc. If you’re missing any documents you need, you can often get copies of them from the IRS (for free).

Prepare Your Tax Return

Whether you hire a tax professional, use an online software program, or fill out the paperwork on your own, plan to spend a couple hours on each year that you need to file. You cannot electronically file previous year returns, but you can use tax software to help you file and then mail the return to the IRS.

Depending on your situation, it may be in your best interest to work with a tax professional as they can help you deal with the IRS over back taxes. They have experience negotiating with the Internal Revenue Service.

Once you fill out the paperwork, you’ll know whether you are owed a tax return or if you owe the IRS for back taxes.

Mail each of your tax returns in separate envelopes, and mail them with Certified Mail. This will let you know when each has been received by the IRS. Keeping each year in separate envelopes will prevent clerical errors by the IRS if viewing multiple years of returns all at once.

Get Your Tax Refunds

If you are owed a refund, you have three years to claim it before it becomes property of the U.S. Treasury. If you are owed a refund for one year you’re filing for, but owe taxes for other years – your refund will first be applied to the taxes you owe. If you owe back child support or are late paying federal student loan payments, your refund will be used to pay those debts before you receive any, as well.

Pay Taxes Owed

If you find you owe the IRS for back taxes, make a plan for how you will pay them. If you have enough to pay it off in one lump sum – this is your best option, of course! It will save you on late fees and penalties and interest charged. If you owe more than you can afford to pay, you can work with the IRS to set up a monthly payment plan; or compromise and pay less than the total amount owed in some situations. Do not ignore the IRS or the fact that you owe them money as it can result in tax liens, wage garnishment, and more.

Plan for the Future

While you’re getting your taxes situated for previous years, take some time to plan for future years. You can ask your employer to withhold additional taxes if you fear you’ll owe taxes. You can change your tax withholdings and dependents, or send the IRS estimated tax payments on a quarterly basis to reduce the possibility of owing taxes the next time you file.

Currently, John Elway is reported to owe almost 6,000 in back taxes ($5,885.97 to be exact).  The tax lien was filed 6/20/2007 by the Oklahoma Tax Commission and lists his property in Englewood, Colorado as the main address. We were able to confirm it with Oklahoma County after it was reported by a few sources.

For those that don’t know who Brooke Shields is, she is an actress and model that is known for her roles in Pretty Baby, The Blue Lagoon, Suddenly Susan, That 70′s Show, Hannah Montana and many others. In 2005 Shields publicized her battle with postpartum depression with the recent child birth and the death of her father 3 weeks later.

Celebrities seem to be a huge target for the IRS lately. It is either the celebrities are having a harder time paying their taxes or it is just proof that the IRS is stepping up collection actions in order to collect more taxes. The IRS did hire more agents this year which is giving them the ability to catch more individuals than ever with tax problems.

You would think IRS Commissioner Doug Shulman would file his own taxes, right? While this would make sense, on the other hand it is justified. Shulman has openly admitted that he does not file his own taxes because the tax code is too complex.

During a recent interview with “Newsmakers” on C-Span, Shulman had this to say regarding his use of a professional tax preparer. “I’ve used one for years. I find it convenient. I find the tax code complex so I use a preparer.”

As you can imagine, this led to several questions about how the tax code could be made simpler. After all, if the IRS Commissioner cannot figure out how to file his own taxes it goes without saying that many Americans have to feel the same way.

During the interview Shulman went on to say that he has been using a tax preparer for 10 years. He also estimated that roughly 60 percent of Americans do the same, with another 20 percent relying on tax filing software.

Some people do not see anything wrong with what Shulman said or how he files his tax return. Others see it as a major underlying problem of the US tax code.

The complexity of the tax code is a one of the many reasons why individuals end up with back taxes and unfiled IRS tax returns. The IRS could simplify the tax code with a flat tax that excludes deductions and save Americans billions of dollars a year.

Daschle failed to report payments to cover a luxury car and driver provided to him by a luxury investment firm. He claims he didn’t think to report this on his taxes. He paid the $140,000 he owed.
